Tenenbaum to step down as CPSC chief, Adler in as Acting Chairman

Consumer Product Safety Commission (CPSC) Chairman Inez M. Tenenbaum will be stepping down from her position on November 30 after serving 4 ½ years as the Chair, CPSC’s OnSafety blog reported (CPSC OnSafety, November 5, 2013). Tenenbaum will be joining the law firm of Nelson Mullins Riley & Scarborough, and will be part of the firm’s Product Safety, Risk Prevention & Regulatory Practice Group.

In addition, Commissioner Nancy Nord left the agency on October 26 after serving for 8 years. Nord had served as Acting Chairman from 2006 to 2009.

In an address at the International Consumer Product Health and Safety Organization’s annual meeting in February of this year, Tenenbaum had announced that she would not seek renomination when her term expired in October 2013. During Tenenbaum’s tenure, the agency created a new five-year Strategic Plan (2011-2016) in an effort to make CPSC more proactive and focused on injury prevention. Some of the agency’s accomplishments under Tenenbaum include participating in bilateral and trilateral safety summits with the People’s Republic of China, the European Union, Canada, and Mexico. CPSC completed 40 final rules since the adoption of the Consumer Product Safety Improvement Act, established requirements for children’s product certification and required third-party testing, and published guidelines and requirements for mandatory recall notices.

Beginning on December 1, Commissioner Robert Adler, the current Vice Chairman, will take over as Acting Chairman of the agency, CPSC indicated. Adler has served on the Commission since August 2009, and previously served for nine years as an advisor to two commissioners. Adler was involved in creating the product safety database called “,” and helped develop independent, third-party testing of children’s products.

The departures of Tenenbaum and Nord will leave the CPSC two commissioners shy of a full slate. Nominations for these positions have not yet been announced by President Obama. Commissioners Robert Adler, Ann Marie Buerkle, and Marietta Robinson are the three current commissioners.
