Jury slams Boston Scientific with $100 million mesh product verdict

Medical device manufacturer, Boston Scientific Corporation, has been ordered to pay $100 million in damages to a patient whose action against it asserted permanent and serious injuries caused by the manufacturer’s Advantage Fit and Pinnacle transvaginal mesh (TVM) products, according to a news release by the patient’s law firm, Motley Rice LLC (Barba v. Boston Scientific Corp., C.A. No. N11C-08-050 MMJ, May 28, 2015).

A Delaware jury awarded $25 million in compensatory and $75 million in punitive damages to Delaware resident, Deborah Barba, after finding that the medical device manufacturer negligently designed and manufactured the mesh devices and also failed to warn unsuspecting doctors and patients of the dangerous risks of the product.

Barba, age 51, was implanted with both transvaginal mesh devices in May 2009 to treat pelvic organ prolapse (POP) and stress urinary incontinence (SUI). After the implantation surgery, she experienced complications and went through two subsequent surgeries as a result. Moreover, in spite of the follow-up surgeries, portions of the mesh product remain embedded in the patient, with little hope of full extraction, according to the news release.

“I am thankful for the jury’s verdict and hope my story can help other women who are suffering from mesh complications to receive the resolution they deserve,” said Barba. “While difficult to share, I hope my case demonstrates to all mesh manufacturers the dangers of their products and the justice they owe victims.”
