Former exec for commercial flooring contractor pleads guilty to bid rigging

Former sales vice president for Chicago-based commercial flooring contractor agrees to cooperate and likely faces a fine and a year in prison.

Michael P. Gannon, a former Vice President of Sales for an unnamed, Chicago-based commercial flooring contractor pleaded guilty in the federal district court in Chicago on April 18 for his role in a conspiracy to rig bids and fix prices. The Department of Justice announced the charge against Gannon earlier this month. Under the plea agreement, the government has recommended that Gannon be sentenced to pay a $28,000 fine and to serve a period of imprisonment of 12 months and one day. The government is not seeking restitution from the defendant. The final sentence is up to the district court judge (U.S. v. Gannon, Case: 1:19-cr-00302).

The charge against Gannon was the first disclosed by the Department of Justice Antitrust Division in its ongoing investigation. More charges are expected, but to date no other charges have been announced.

Gannon admitted to participating in the conspiracy from 2009 until 2017. While no companies were named in the filing, three firms are alleged to have participated in the challenged conduct. Gannon’s employer was not identified; however, during the relevant period, a Michael Gannon worked for Mr. David's Flooring International, LLC, a commercial flooring distribution and installation company based in the Chicago area. The filing refers to five unidentified co-conspirators affiliated with Gannon’s company, including three owners, a sales manager, and a vice president. There also are references to individual co-conspirators associated with the two other companies.

A status hearing was set on July 17. A sentencing hearing has not yet been scheduled.
